Terms & Conditions

We welcome your participation in our GamingPeak forum for comments and new threads. We encourage you to analyze, comment on and even challenge the critical thinking of others as they post ideas, reviews and other intellectual pursuits. It is our hope that you’ll take the opportunity to interact with others in our community in a constructive way, and well as with the management and administration of the site.

In order to keep these experiences enjoyable and interesting for all of our users, we ask that you follow the rules outlined below in conjunction with our GamingPeak Code of Conduct. By participating at our site and specifically in our forums, you are consenting to these additional rules:

1. You understand and agree that GamingPeak is not responsible for any content posted by third parties. You further understand that GamingPeak may monitor any/all user-generated content and reserves the right to remove, edit or otherwise alter any content that it deems inappropriate for any reason whatsoever, without needing your consent or approval.
2. GamingPeak further reserves the right, in its sole discretion, to remove a user’s privilege to post content on our site, or remove users from the site entirely for chronic disrespect for the rules.
3. You agree that you are fully responsible for the content that you post. You should not knowingly post content that violates the copyright, trademark, patent or other intellectual property rights of any third party and that you will remove (or we can remove) the same should you (or we) discover that you have violated this provision. Likewise, you may not post content that is libelous, defamatory, obscene, abusive, that violates a third party’s right to privacy, that otherwise violates any applicable local, state, national or international law, or that is otherwise inappropriate. You will indemnify GamingPeak (www.gamingpeak.com), its owner, and all unpaid volunteers or site representatives from any and all claims and/or damages (including but not limited to reasonable attorneys’ fees) resulting from any claim brought by any third party relating to content you have posted.
4. You may not post content that degrades others on the basis of gender, race, class, ethnicity, national origin, religion, sexual preference, disability or other classification. Epithets and other language intended to intimidate or to incite violence will not be tolerated, and removed. Furthermore, you may not impersonate others.
5. Posting and acting respectfully always applies at our site and in our forum. It is inconsiderate and not respectful to bump threads to the top of the forum without additional content of value being delivered to a thread via a new post in that thread. Posters that bump threads either directly or surreptitiously could lose their privileges to post, and the post could be returned to its previous position.
6. You understand and agree that the discussion forums are to be used only for non-commercial purposes. You may not solicit funds, promote commercial entities or otherwise engage in any unsanctioned commercial activity in our discussion forums. GamingPeak approved business partners may post in accordance to considerations agreed to and according to the rules of the business partnership agreement.
7. You acknowledge and agree that you may use and/or rely on any information obtained through the discussion forums, but do so entirely at your own risk. GamingPeak is not in any manner endorsing the content of the discussion forums and cannot and will not vouch for the reliability or authenticity of anything posted there.
8. For any content that you post, you hereby grant to GamingPeak the royalty-free, irrevocable, perpetual, nonexclusive and full license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content in whole or in part, world-wide and to incorporate it in other works, in any form, media or technology now known or later developed.
